Melaksanakan keadilan berasaskan bidangkuasa yang diberi oleh Undang-undang dan Perlembagaan selaras dengan Hukum Syarak.

Fungsi

  • Menerima, mendengar dan memutuskan kes-kes yang dibawa ke Mahkamah Syariah mengikut hukum Syara’ dan peruntukan undang-undang.
  • Memutus, menguatkuasa dan melaksanakan perintah berasaskan Hukum Syara’ dan undang-undang bertulis.
  • Menerima, mendengar dan memutuskan kes-kes rayuan secara teratur dan berkesan;
  • Menerima, mendengar dan memutuskan permohonan pembahagian Faraid;
  • Membangunkan Sumber Manusia yang terlatih dan mencukupi;
  • Menyelesaikan pertikaian secara Majlis Sulh berasaskan persetujuan tanpa sebarang paksaan melalui kaedah perundingan dan timbangtara.
  • Melaksanakan e-syariah dan Sistem Perakaunan Standard Kerajaan Negeri (SPEKS).

Client's Charter

CLIENT'S CHARTER OF MELAKA SYARIAH COURT
 1   Customer will be given a date form mention/ hearing/ sulh on the same day after their completed application has been registered;
2  90% registered case will be mentioned/ heard and sulh will be conducted within 21 days after its registration date;
3  To ensure every Sulh cases are solved within 3 months;
4  To issue 90% Certificate of Faraid within 14 days after the order of distribution;
5 Written Judgement shall be issued within 14 days after pronouncement of decision for the cases in the event of application;
6  To hear appeal within 3 months after the record of appeal is completed by the parties involved.

Background

The Melaka Syariah Court (hereinafter refferred as "MSC") was constituted under the Section 39 of Administration of Syariah Law (State of Melaka) 1959. Since its early establishment until 1989, MSC was put under the administration of Melaka Islamic Religious Department. (hereinafter referred as "MIRD").

However, the administration of MSC was separated from MIRD in year 1990 and it operated at MIRD’s building in Jalan Tengkera and was then relocated to the Red Building at Jalan Kota. Later, it then moved to Jalan Kee Ann. In 1995 MSC then shifted to Malacca Court Complex, Lebuh Ayer Keroh, Melaka and emains here until now.

The MSC has jurisdiction over Civil Mal cases, criminal, and distribution of property (faraid) cases in all hierarchy of Syariah courts whereby it comprises Syariah Subordinate Court, Syariah High Court and Syariah Court of Appeal which are provided under Islamic Family Law (State of Melaka)Enactments 2002, Administration of the Religion of Islam (State of Melaka) Enactment 2002, Syariah Criminal Procedure(State of Melaka) Enactment 2002, Syariah Court Evidence (State of Melaka) Enactment 2002 and Syariah Criminal Offences Enactment 1991. The administration of Syariah Subordinate Court has been delegated into three districts in Melaka Tengah, Alor Gajah and Jasin.
